Emma Evans
Emma Evans has a broad litigation practice in which she represents companies and individuals as both plaintiffs and defendants in a wide range of complex commercial disputes. Her experience encompasses breach of contract, fraud, trade secrets, intellectual property infringement, business torts, defamation and reputation-based claims, partnership disputes, and business divorces.
Emma represents clients across multiple industries in federal and state courts, as well as before various arbitral tribunals. She also counsels clients pre-litigation including sending or responding to cease and desists and demand letters, counseling regarding potential claims and defenses, and assessing legal exposure and risk.
Representative Matters
- Representation of a C-suite executive and her financial services company to respond to non-party subpoenas for document production and depositions in a matter involving misappropriation of trade secrets, unfair competition, and other business issues.
- Representation of a pharmaceutical company in a multimillion-dollar action involving claims of breach of contract, fraud, and related business torts.
- Representation of a leading waste and recycling solutions provider in a multimillion-dollar fee dispute with a global investment bank arising from the bank’s underwriting of a SPAC IPO and involvement in the de-SPAC business combination transaction.
- Representation of one of the largest proprietary trading firms in a FINRA arbitration regarding a multimillion-dollar breach of contract dispute.
- Representation of the Federal Deposit Insurance Corporation as Receiver for Signature Bank and First Republic Bank in a civil litigation in which plaintiffs asserted tort claims arising from alleged pre-failure conduct at each bank.
- Representation of a co-owner and co-managing member of a real estate management company, which oversees a portfolio of affiliated properties in the New York metropolitan area, in various matters, including arbitrations and matters arising from a “business divorce” between he and his partner.
