CLE: Successfully Navigating Parallel Proceedings

Ricardo Solano, Jr.
Kansas City Marriott Downtown Hotel, Kansas City, MO
September 8, 2017

Ricardo Solano presented on a panel addressing the management of parallel and civil proceedings at the 2017 Hispanic Bar Association Annual Convention, held from September 6-9 in Kansas City, MO.

In various areas of criminal law, including, for example, False Claims Act, FCPA, FDA, and securities cases, the government often commences a civil or regulatory case or investigation to run concurrent with an ongoing criminal investigation. Even when it does not, a government criminal investigation in these areas may lead to private civil lawsuits. Attorneys that represent companies and individuals facing such a situation must carefully balance the at-times competing interests of the client in the different forums and avoid potential pitfalls, such as inadvertently waiving a privilege by the actions taken in one proceeding.

Mr. Solano's panel discussed strategies for successfully navigating parallel proceedings, handling discovery issues, protecting client privileges, and opportunities for using the different proceedings to the client's advantage.  The session took place on Friday, September 8 from 2:15-3:30 PM ("Successfully Navigating Parallel Proceedings").

Mr. Solano's co-panelists included Hasan Ibrahim, Chief Legal Officer and Vice President at Prudential Advisors, Wilfredo Ferrer, a partner at Holland & Knight, Mayling Blanco, a partner at Blank Rome, and Natasha Trifun, an associate at King & Spalding. The panel was moderated by Carlos Ortiz, Partner & Co-Chair of the White Collar Defense and Investigations practice at Blank Rome in New York.
