Jennifer Mustes represents major public and private companies in complex commercial litigations and arbitrations, including at trial, in federal and state courts, and before regulatory bodies. Her practice focuses in particular on matters concerning employment law and business torts.
Participated in the successful defense of one of the world's most prominent inter-dealer brokerage firms in eight consolidated FINRA arbitrations as well as in a follow-on five-month jury trial in New Jersey state court defending against claims of "raiding" and other business torts. In the FINRA arbitrations, the panel ultimately awarded claimants a fraction of the damages they sought, and awarded significant damages to the employees hired by the client. The jury trial settled favorably in 2015 following the close of evidence and the court’s dismissal of the plaintiffs’ core racketeering claim.
- Represented a global investment bank in a FINRA arbitration addressing breach of contract, fraud, and other claims brought against the bank by former employees.
Defended a major financial services firm in a FINRA arbitration involving claims of improper hiring, breach of fiduciary duty, and theft of confidential information. At the close of the hearing, the Panel denied plaintiff's multi-million dollar claims in their entirety and awarded damages to the employees hired by the client.
Secured complete dismissal of complaint alleging employment discrimination claims in the Southern District of New York.
Representation of individuals in connection with governmental investigations.
- Represented a major wireless carrier in successful resolution of a contractual dispute.
- Obtained dismissal of class action claims of securities fraud and control person liability against a former senior public company executive.
