Lack Speaks on Accountants' Liability Litigation at Judges' Conference

Friedman Kaplan partner Robert J. Lack spoke on November 1 on "Emerging Litigation Involving Accounting Firms" at the first annual conference of the American College of Business Court Judges at The Brookings Institution in Washington, D.C. The conference, organized by the American Enterprise Institute-Brookings Judicial Education Program of the AEI-Brookings Joint Center for Regulatory Studies, brought together judges from 21 states that have or are seeking to develop courts with a specialization in business or commercial cases.

Together with co-panelist Michael R. Young of Willkie Farr & Gallagher LLP, Lack spoke and answered questions from the judges about a variety of topics, including the auditor's responsibility for the detection of fraud and the varying approaches states have taken to the question of who can sue an accountant for negligently prepared audit reports.

The conference was led by an Executive Committee composed of The Honorable William B. Chandler III of the Delaware Court of Chancery, The Honorable Steven I. Platt of the Circuit Court for Prince George's County, Maryland, The Honorable Renee Roche of the Ninth Judicial Circuit Court of Florida, and The Honorable Ben F. Tennille of the North Carolina Business Court.
