FKSA Defends $280 Million Claim Against Leaseholder of 7 World Trade Center On July 1, 2005, the United States Court of Appeals for the Second Circuit affirmed the dismissal of a $280 million claim by Citigroup, Inc. on insurance proceeds for 7 World Trade Center, one of the buildings destroyed on September 11, 2001. The 7 World Trade Center building is the first of the buildings destroyed in the terrorist attacks to be rebuilt, and all insurance proceeds have been committed to that effort. Citigroup, a major tenant in the prior building, brought an action against 7 World Trade Company, L.P.'s insurer, claiming that it was entitled to more than $280 million in insurance proceeds as a loss payee under a policy held by 7 World Trade Company, L.P. FKSA represented 7 World Trade Company in intervening in the action to protect the Company's rights to all insurance proceeds. The Second Circuit panel of Judges Jon O. Newman, Ralph K. Winter, and Sonia Sotomayor, in a per curiam decision, affirmed Judge Miriam Goldman Cedarbaum's grant of 7 World Trade Company's motion for summary judgment, holding that 7 World Trade Company lacked an insurable interest in Citigroup's property and that that property was not covered by the insurance policy.
