Firm Achieves Favorable Settlement After Two Weeks of Trial Following two weeks of trial, Friedman Kaplan achieved a very favorable settlement for its clients Honeywell International, Inc. and Jayhawk Fine Chemical in a breach of contract and copyright infringement action in the United States District Court for the District of New Jersey. The plaintiff, Q-CIM, Inc., developed software that Honeywell licensed for use at a number of its chemical plants. Q-CIM alleged that Honeywell and Jayhawk breached certain licensing agreements and infringed its copyright by using the software at more locations than was permitted under the contracts. The defendants, while admitting limited over-usage of the software, asserted that most of the alleged infringing use was permitted under the licensing agreements. At the close of the plaintiff's case, during which FKSA litigation partner Paul J. Fishman cross-examined Q-CIM's president for three days, Q-CIM agreed to settle the case for less money than Honeywell had offered before trial began. Mr. Fishman was assisted at trial by associates Michael A. Berg and Joshua A. Polak. |
