FKSA Team Obtains 75-Month Sentence Reduction for CJA Client

FKSA litigation partner Mary E. Mulligan and associate Jennifer P. Krakowsky recently achieved a significant result for a client in which the firm was appointed as post-appeal counsel pursuant to the Criminal Justice Act. After the Second Circuit Court of Appeals remanded the case for resentencing, FKSA submitted to the District Judge a sentencing memorandum, which argued that the client's original sentence of 225 months' imprisonment was disproportionately harsh in light of the 180-month sentence imposed upon a more culpable co-defendant charged in the same conspiracy. FKSA also argued that the client's sentence should be reduced based on a number of other factors, including the client's compelling family circumstances. The District Judge reduced the client's sentence to 150 months' imprisonment.
