Berman to Speak on Non-Party Discovery in Federal Court In June, FKSA partner Scott M. Berman will participate in a CLE program titled "Winning Cases in Federal Court" sponsored by the New York County Lawyers' Association (NYCLA). The program will explore the latest developments in federal civil practice, and provide a comprehensive grounding in key federal and local rules and how to use them effectively. Mr. Berman will speak on "Non-Party Discovery: Things You Need to Know That Nobody Tells You." The program will also include in-depth presentations on tactics and techniques that have proven to be successful in federal courts, including strategic issues to consider in commencing an action and responding to a complaint; what discovery is required, what discovery is permitted and how to handle discovery disputes; how to prepare for, take and defend depositions; expert discovery; when and how to move for summary judgment, and how to defeat a summary judgment motion; strategies and techniques for winning a trial in federal court; an overview of post-trial procedure, including post-trial motions, appeals and enforcement of judgments; and ethical considerations.
