Insurance Matters

We have had broad experience in the insurance area, and have represented insurance companies in a wide variety of matters. In addition, insurance companies have retained us, or approved our retention, for the defense of clients in a number of securities fraud and other cases. We have represented:

• Three major insurers in coverage litigation brought by a Fortune 100 company relating to the company's settlement of nationwide consumer class actions and governmental investigations. Our clients counterclaimed to rescind their policies in the litigation, in which more than 70 days of depositions were taken during a 6-month period.

• A prominent defense contractor in a dispute with another company and various London insurers regarding the availability of insurance coverage and associated contractual breaches. The dispute arose following a complex corporate restructuring and spin-off that separated the insured subsidiaries of a conglomerate. The action was litigated on an expedited basis and tried in Delaware Chancery Court.

• 7 World Trade Company, L.P. in an appraisal action and federal litigation concerning the adjustment of an $860 million insurance policy covering 7 World Trade Center.
