Paul J. Fishman represents individual and corporate clients in white-collar criminal matters, corporate investigations, and complex civil litigation, including proceedings in federal and state court and before various regulatory agencies such as the Securities and Exchange Commission. His recent matters have included the representation of individuals and corporations being investigated for insider trading, defense contractor fraud, export control violations, fraudulent marketing of securities, money laundering, and tax evasion; overseas internal investigations for two large, publicly traded corporations; breach of contract, breach of fiduciary duty, Lanham Act, and securities litigation in federal courts in New York, New Jersey, and the District of Columbia; and the drafting and revision of compliance programs for a number of companies.
Mr. Fishman graduated magna cum laude in 1978 from Princeton University and cum laude in 1982 from Harvard Law School, where he served as the Managing Editor of the Harvard Law Review. After a clerkship with The Honorable Edward R. Becker of the U.S. Court of Appeals for the Third Circuit, he became an Assistant United States Attorney for the District of New Jersey. While in that office, Mr. Fishman served as Deputy Chief of the Criminal Division, Chief of Narcotics, Chief of the Criminal Division, and First Assistant U.S. Attorney. From 1994 through 1997, he served as a senior adviser to the Attorney General and Deputy Attorney General of the United States on a variety of law enforcement, policy, legislative, national security, and international matters, as well as on specific investigations and prosecutions.
Mr. Fishman served as Chair of the Lawyers Advisory Committee for the U.S. Court of Appeals for the Third Circuit, and is a former Vice Chair of the American Bar Association's White Collar Crime Committee. He currently serves as Second Vice President of the Association of the Federal Bar of the State of New Jersey, Secretary of the Board of the Yogi Berra Museum and Learning Center in Little Falls, New Jersey, a member of the Editorial Board of the New Jersey Law Journal, and a member of the Board of Governors of the Third Circuit Bar Association. Mr. Fishman is also admitted in New Jersey and the District of Columbia.
Mr. Fishman has been selected for inclusion by Law & Politics in Super Lawyers® 2008 New York Edition for having attained the highest degree of peer recognition and professional achievement in the multiphase Super Lawyers selection process which includes, among other factors, peer evaluation. He also received this designation in 2007, and was selected for inclusion in the New Jersey edition of Super Lawyers (in 2005, 2006, 2007, and 2008). In addition, he was selected for inclusion in The Best Lawyers in America® 2009 (Copyright 2008 by Woodward/White, Inc., of Aiken, S.C.), also a peer review publication, in the field of appellate law practice.
Mr. Fishman is currently serving as an advisor to the transition team that is reviewing the U.S. Department of Justice for the Obama administration.
