Daniel B. Rapport
Daniel B. Rapport represents plaintiffs and defendants in complex commercial litigation and arbitration, involving claims such as common law fraud and securities fraud, fraudulent conveyance, antitrust, consumer protection, and accounting malpractice. Mr. Rapport has advised well-known companies such as Wells Fargo, Wachovia, The Bank of Bermuda Ltd., and T-Mobile, as well as private companies, hedge funds, governmental organizations, and bondholder groups.
Mr Rapport's recent and current matters include representation of:

Wells Fargo and Wachovia in litigation with Citibank arising out of the merger of Wells Fargo and Wachovia;

The Bank of Bermuda Ltd. in federal court garnishment proceedings, including a certified appeal to the New York Court of Appeals on an issue of first impression;

a litigation trust formed under the bankruptcy reorganization plan for Marvel for the prosecution of breach of fiduciary duty claims against Marvel's former controlling shareholder and affiliates (the case ended with a substantial settlement for our client after a successful appeal to the U.S. Court of Appeals for the Third Circuit, Cantor, et al. v. Perelman, et al., 414 F.3d 440 (3d Cir. 2005));

a major government-sponsored financial institution in Asia in an UNCITRAL arbitration arising out of the sale of non-performing loans to a major U.S. investment bank;

hedge funds with respect to internal governance and management practices.
Mr. Rapport graduated Phi Beta Kappa and cum laude from Harvard College in 1990 and received his law degree from Yale Law School in 1995. After law school, he clerked for The Honorable Miriam Goldman Cedarbaum of the U.S. District Court for the Southern District of New York. Mr. Rapport is a member of the New York City Bar.
