Lance J. Gotko
Lance J. Gotko's practice focuses on a wide variety of complex commercial litigation, involving many different fields, such as the securities industry, hotel management, petroleum distribution, publishing and other media, retail clothing, graphic design, beauty products, vehicle manufacturing, and aircraft financing. Mirroring the firm's litigation practice, the common threads throughout Mr. Gotko's varied matters are strategic thinking, forceful advocacy, and a strong grasp of complex factual and legal settings. His recent matters have included claims involving allegations of securities fraud, theft of computer source code, breaches of non-compete agreements and employment contracts, breach of fiduciary duty, non-payment of investment banking fees, business conspiracy, accountant negligence, and false arrest, as well as disputes involving business partnership breakups, RICO, and the Petroleum Marketing Practices Act. Mr. Gotko has participated in multiple bench and jury trials and arbitrations.
In addition to regularly representing corporations in employment-related matters, Mr. Gotko also represents business people at key junctures in their careers. In this regard, as a member of the firm's Executive Employment Practice Group, he has represented a number of highly compensated individuals and groups of executives in negotiations with employers and prospective employers, and in litigation brought by former employers. He also has represented individuals in both internal investigations and proceedings brought by various regulatory and government agencies such as the Securities & Exchange Commission and the U.S. Department of Justice.
Mr. Gotko is a mediator for the New York Supreme Court Commercial Division in New York County, and an arbitrator for the Civil Court of the City of New York. He also is a member of the Advisory Committee for the Commercial Division (New York County), which helps bring issues and ideas to the attention of the justices of the New York Supreme Court's Commercial Division. From 2002 to 2005, Mr. Gotko served as a member of the Committee on Courts of Superior Jurisdiction of the New York City Bar. He is a member of the Federal Bar Council.
Mr. Gotko graduated from Michigan State University in 1985 and received his law degree magna cum laude from Brooklyn Law School in 1988. After law school, he served as a law clerk to The Honorable John R. Bartels of the United States District Court for the Eastern District of New York and The Honorable Morton I. Greenberg of the United States Court for Appeals for the Third Circuit. He previously practiced at Sullivan & Cromwell.
