Eamonn O'Hagan

Eamonn O'Hagan represents both debtors and creditors in bankruptcy, insolvency, restructuring, and reorganization matters in numerous industries. Representative matters that Mr. O'Hagan has worked on include:

  • In re Refco Inc. (counsel to chapter 11 debtors)
  • In re Delphi Corp. (counsel to chapter 11 debtors)
  • In re SCH Corp. (counsel to chapter 11 debtors)
  • In re Uno Restaurant Holdings Corp. (special counsel to chapter 11 debtors)
  • In re Movie Gallery Inc. (counsel to agent for First Lien Lenders)
  • In re The Source Enterprises, Inc. (counsel to preferred shareholder/DIP lender)
  • SIPC v. Bernard L. Madoff Investment Securities LLC and In re Fairfield Sentry Ltd. (counsel to various parties in connection with hundreds of millions of dollars of threatened clawback claims)
  • In re Lyondell Chemical Co. (counsel to Bank of New York Mellon, indenture trustee for certain noteholders, as plaintiff and intervenor in $22 billion fraudulent transfer action arising out of leveraged buyout)

Mr. O'Hagan is the author of Stop Changing the Subject! Recent Supreme Court Jurisprudence on Whether Statutory Requirements are Subject Matter Jurisdictional or Claims Processing Rules, Norton Journal of Bankruptcy Law and Practice, Vol. 20, No. 1 (2011), and Judicial Illumination of the Constitutional "Twilight Zone": Protecting Post-Arrest, Pretrial Suspects from Excessive Force at the Hands of Law Enforcement, 44 B.C. L. Rev. 1357 (2003). He is also a co-author of The Changing Paradigm in Distressed Debt and Claims Buying: Scrutinized Lending and Capital Markets Issues , American Bankruptcy Institute, Bankruptcy 2008: Views From the Bench, September 12, 2008, and a contributing author to Norton Bankruptcy Law & Practice (3d ed.), Thomson/West, Chapter 87: Financing the Debtor in Possession.

Mr. O'Hagan graduated summa cum laude from Rutgers University in 2001 with a degree in political science and received the Rutgers College Dean's Award for Academic Excellence. In 2004, Mr. O'Hagan received his J.D. magna cum laude from Boston College Law School, where he served as a Senior Editor of the Boston College Law Review. After law school, he clerked for The Honorable William G. Young, Chief Judge of the United States District Court for the District of Massachusetts.

Mr. O'Hagan previously practiced at Skadden, Arps, Slate, Meagher & Flom LLP. He is also admitted in New Jersey.
